Terms of Service

Version 1.1.0 · Effective October 2, 2026 · Last updated October 2, 2026

These Terms are an agreement between you and Gregarious, Inc. of Delaware. They cover the Butter app, butter.yoga, and our sessions, membership, and support. We call these "Butter". Our Privacy Policy and health data policy are separate documents. Data choices are separate from accepting these Terms.

What you're agreeing to

Who can use Butter

You must be at least 18 years old and able to legally agree to these Terms. When you accept them, you confirm that you meet both requirements.

Butter is made for people in the United States. If you use it from anywhere else, these Terms still apply, but we make no promise that Butter works or is lawful there.

You accept these Terms when you select the agreement box and confirm your choice in the app. If you do not agree, do not use Butter. Agreeing to these Terms does not replace the separate choices you make about health data or optional emails.

What Butter is, and what it is not

Butter gives you guided yoga and mobility sessions planned by an AI guide. Your guide uses what you choose to tell it, such as injury notes, the areas you want to work on, and your session history. It plans your sessions from that and speaks to you about your practice.

Butter is a general wellness product. It is not medical care, medical advice, diagnosis, or treatment. It is not rehabilitation or any licensed health service. It does not replace a doctor or any other licensed health professional. Using Butter does not create a doctor-patient relationship, or any other clinical relationship, between you and us.

Check with a doctor before you start, and before you make decisions about your health. Never ignore a doctor's advice, or put off getting it, because of something Butter said.

Butter is not for emergencies. If you are hurt or in danger, call 911.

What happens if you get hurt

Yoga, stretching, and mobility work can cause injury. This includes muscle strain, joint injury, and a flare-up of an old problem. Serious injury can happen too. Talk to a doctor before you start. That matters most if you are pregnant, have a heart condition, or have had an injury or surgery. It also matters if you have any condition that exercise could affect.

Stop if you feel pain. Stop if you feel dizzy, short of breath, or anything beyond normal muscular effort. Get medical help if it does not pass. Your guide plans around what you tell it. It cannot see you or examine you, and it cannot know how your body feels right now. Do not rely on your guide to decide whether a move is safe for you. Make sure the space around you is clear before you start.

Release of injury claims

Yoga, stretching, and mobility work can cause injury, including serious injury. You choose to take part and accept those risks.

Where the law allows, you give up injury claims against Butter and its team for our ordinary negligence. That means failing to use reasonable care, including careless coaching.

This does not cover gross negligence, reckless or intentional misconduct, fraud, or rights the law protects.

Who and what this covers

Butter is Gregarious, Inc. Its team means its directors, officers, employees, and contractors. This release covers injury, illness, and related loss caused by our ordinary negligence in creating, running, or delivering Butter. It includes session plans and guidance that is wrong for your body. It applies to your use of Butter after you agree, including future sessions. It applies only as far as your state's law allows.

Your account

You can use Butter without creating an account. Your practice is then tied to your device, and you can still buy a membership. To keep your history across devices, you can create an account with Sign in with Apple.

If you create an account, you agree to give us accurate information and keep it current. Keep your sign-in details to yourself. You are responsible for what happens under your account. If you think someone else is using it, email support@butter.yoga right away.

You can delete your account at any time in the app under Profile › Account › Delete account. What deletion does to your data is in the Privacy Policy. What it does to your membership is under Ending things.

How membership works

You can use parts of Butter without paying. A membership unlocks the rest. If you buy a membership on butter.yoga, Stripe handles billing. If you buy inside the app, Apple handles billing. The way you buy decides how billing, cancellation, and refunds work, so we describe both.

Both kinds of membership renew automatically until you cancel. Cancelling is always free and never needs a phone call.

If you subscribe on butter.yoga

Your membership starts with a 7-day free trial. To start the trial you enter a card, unless a gift code covers your membership.

When the trial ends, we charge your card the price you chose: $99 for a year, or $14.99 for a month. We charge the same price again at the start of every new period until you cancel. If you cancel during the trial, we never charge you.

At checkout we show you the price, how often it renews, the date your trial ends, and the date of your first charge. You agree to those renewal terms with a separate tick before you finish checkout.

Right after you subscribe, we email you the price, how often it renews, the date your trial ends, and how to cancel. We email you at least 3 days before your trial ends. If you have a yearly membership, we email you 30 days before it renews, with the price and how to cancel. If you have a monthly membership, we email you a receipt for every charge. Once a year we also remind you of the price and how to cancel.

Stripe handles your card. We never see or store your card number.

If you subscribe through Apple

For memberships bought inside the app, Apple bills you. Apple's rules for trials, renewal, and cancellation apply to that membership. It renews through Apple until you cancel it in iOS Settings › your name › Subscriptions. If we raise the price, Apple tells you first and, under Apple's rules, may ask you to agree before it charges you. Apple handles refunds for these purchases. See Refunds.

How to cancel

If you subscribed on butter.yoga, cancel online through Profile › Membership › Cancel membership in the app. Or email support@butter.yoga with "cancel" in the subject line. You do not need to call us.

Cancelling stops future renewals. You keep paid access until the end of the period you paid for, unless you also receive a refund for that period as described below.

If you subscribed through Apple, cancel in iOS Settings › your name › Subscriptions. Profile › Membership in the app opens that screen for you.

Refunds

If you paid on butter.yoga, ask within 30 days of any charge and we refund that charge in full. After 30 days, ask and we refund the unused part of the period you paid for.

When we issue a refund for your current paid period, we stop renewals and end that paid access. Your free account and session history stay unless you choose to delete them. A refund to correct a duplicate charge or billing mistake does not end otherwise valid paid access. Refunding an earlier period does not end access paid for by a later charge.

To ask, send one message. Use Profile › Chat with Concierge in the app, or email support@butter.yoga. We never ask you to call.

If you paid through Apple, Apple issues refunds under its own rules. Ask Apple at reportaproblem.apple.com, or ask us and we point you to the right place. We cannot refund an Apple charge ourselves.

Some laws give you more refund rights than this. Nothing here takes those away.

Price changes

If we change the price of a butter.yoga membership, we email you before the new price takes effect, with a link to cancel. The email comes at least 7 days and at most 30 days ahead. For New York members, it also comes at least 5 business days ahead. The new price applies from your first renewal after that date. If you do not want to pay it, cancel before then.

If you live in New York and we raise your price without your agreement, state law gives you a cancellation and refund right. You can cancel within 14 days of the first higher charge and receive a pro-rata refund for the unused time. Our Refunds policy gives you more: ask within 30 days of a web charge and we refund it in full.

If you subscribed through Apple, Apple tells you about a higher price first. Under Apple's rules, Apple may also ask you to agree before it charges you.

What you must not do

Use Butter for your own practice, and do not use it to harm anyone. You must not:

Your content stays yours

Butter lets you give it content: notes to your guide, voice notes turned into text, profile details, and similar material. That content stays yours. You give us permission to store, process, send, and show it to provide Butter and keep it secure. That includes processing through the providers named in the Privacy Policy. We use your content to find bugs in the existing planner and improve its prompts, performance, and accuracy. We do not use it to train or fine-tune AI models. The Privacy Policy describes these uses. We ask for separate permission before using your content to develop a different product you are not using.

This permission does not replace any consent required to use your personal or health data. It ends when your content is deleted from our systems, except for the de-identified data and records the Privacy Policy says we keep.

You are responsible for your content. Do not give us content you do not have the right to share.

The guide is AI

Your guide is AI. Its session plans, its notes, and its spoken words are generated by artificial intelligence from the information it has. The app labels your guide as AI, and your guide says so if you ask.

Chat with Concierge is different. A person on our team reads and answers every message. Our team can use an AI assistant to draft a reply, but a person reviews and sends it. Hours and reply times are under Contact.

AI makes mistakes. Your guide can suggest a move that is wrong for your body. Nothing your guide says is medical, legal, or other professional advice. Weigh it against your own judgment and, where it matters, against a professional's advice. We work to make your guide accurate and careful. We do not promise that any plan is correct, complete, or right for you.

Companies that run the AI models process your content for us. We do not permit them to train their models on your content. The Privacy Policy names them and explains how long they keep content.

Our work

Butter belongs to us, or to the companies that license parts of it to us. That covers the software, design, audio, text, session content, images, and trademarks. It does not cover your content. We give you a license to use Butter for your own practice, not for business, under these Terms. The license is personal: it is for you, and you cannot pass it to anyone else. It is not exclusive, so we can give the same license to other people. It is limited to what these Terms allow. We can take it back if you break these Terms. We keep every right we do not give you here.

When you get the app from the App Store, Apple's standard app license covers the app software on your phone. These Terms cover the Butter service, your membership, and everything else in this document.

Ending things

You can stop using Butter at any time. To close your account, go to Profile › Account › Delete account in the app.

Deleting your account cancels a membership bought on butter.yoga right away. We refund you without being asked: the whole charge if it was in the last 30 days, and the unused part of the period you paid for if it was earlier. If you subscribed through Apple, deleting your account does not cancel that subscription, and we cannot refund an Apple charge. Cancel it in iOS Settings › your name › Subscriptions, and ask Apple for a refund at reportaproblem.apple.com.

What deletion does to your data is in the Privacy Policy. We keep a record of the agreements you accepted, and any records the law requires us to keep.

We can suspend or close your account if you break these Terms. We can also do that if your use puts Butter or other members at risk, or if the law requires it. Where we can, we tell you first and give you a chance to fix the problem.

If we shut down Butter or a paid feature you paid for, we refund the unused part of a web payment for it. For Apple purchases, Apple's refund process applies, as described under Refunds.

These sections keep working after your account ends: the release, our work, what we do not promise, our liability, disputes, and which law applies. So do the records the Privacy Policy says we keep.

What we do not promise

Butter comes as it is, and as it is available. We do not promise that it will always work or be free of errors. We do not promise that any plan or answer will fit your body. To the extent permitted by law, we make no warranties of any kind, express or implied. That includes the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. A warranty is a legal promise about quality that you could sue on. Some states do not allow these exclusions, so some of them may not apply to you.

What we owe you if something goes wrong

Two limits apply to what we owe you.

First, to the extent the law permits, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. In plain words: we do not pay for knock-on losses. That covers lost profits, lost data, and lost goodwill. It applies even if we knew those losses were possible.

Second, to the extent the law permits, we cap our total liability for everything arising from Butter or these Terms. The cap is the greater of two amounts. One is what you paid us in the 12 months before the event you claim for. The other is $50.

These limits apply whatever the legal theory, including contract, tort, negligence, and strict liability. They apply even if a remedy fails of its essential purpose. They do not apply where the law does not let us limit liability. That includes gross negligence, willful misconduct, and fraud. They do not limit our express refund promises or any rights or remedies that the law does not let you waive.

How we handle disputes

Before starting arbitration or a court case, send us notice at legal@butter.yoga describing the problem and the outcome you seek. We send any notice of a claim against you to the contact address you have provided. You and we agree to try to resolve the dispute for 60 days after the notice is received.

Any time limit for filing the claim is paused during those 60 days, to the extent the law allows. Either side may file sooner to preserve a claim or seek urgent relief. This process does not delay a privacy request, appeal, cancellation, refund, or complaint to a government agency.

Arbitration and class-action waiver

Except for the carve-outs below, you and Gregarious, Inc. agree that any dispute about Butter or these Terms goes to binding individual arbitration, not court. In arbitration a neutral arbitrator, not a judge or jury, hears both sides and makes a final decision. Court review of that decision is very limited. The American Arbitration Association (AAA) will run the arbitration under its Consumer Arbitration Rules.

You and Gregarious, Inc. each give up the right to a jury trial. Each of you also gives up the right to take part in a class action, class arbitration, or any other representative proceeding. Each side brings claims only as an individual, and the arbitrator cannot combine one person's claims with another's.

How arbitration works. The AAA's Consumer Arbitration Rules and filing information apply. The Federal Arbitration Act governs this section. Your filing fee is no more than the lower of AAA's consumer fee and your local small-claims court filing fee. Any fee waiver available under the rules or law still applies. We pay the remaining administration fees and all arbitrator fees. If we bring the claim, we pay the filing fee too. Any hearing takes place in the county where you live, or by video or phone if you prefer. The arbitrator can award the relief that a court could award on an individual claim.

The arbitrator decides whether a claim is covered by this section and whether this section can be enforced. Only a court decides whether the class-action waiver can be enforced.

If AAA declines or stops handling the case under its rules, either side may bring the dispute in a court with jurisdiction.

If many similar claims are filed. If 25 or more people bring the same or similar claims against us through coordinated lawyers, AAA's Mass Arbitration Supplementary Rules apply to those claims.

Carve-outs. Either of us can bring an individual claim in small-claims court instead of arbitration, if it qualifies there. Either of us can ask a court to stop unauthorized use of Butter or infringement of intellectual property.

Public injunctive relief. Nothing in this section stops you from asking a court for public injunctive relief where California law gives you that right. Public injunctive relief is a court order that stops conduct that harms the public, not only you. If any part of this paragraph is found unenforceable, only this paragraph is affected, and the rest of this section stays in force.

If the class waiver fails. If a court finds that the class-action waiver cannot be enforced for a particular claim, that claim, and only that claim, goes to court. The waiver still applies to every other claim.

Opting out. You can reject arbitration and the class-action waiver. Email legal@butter.yoga within 30 days of the day you first accept these Terms. Say that you opt out and give a name and an email where we can reply. If you have an account, include its email if different. If you use Butter without signing in, say so; you do not need to create an account to opt out. We will acknowledge your notice and help record your choice for your use of Butter.

Opting out never affects your use of Butter. If you opt out, the arbitration requirement, jury waiver, and class-action waiver in this section do not apply to you. Other terms still apply, including Which law applies.

If we make a material change to this section, it does not apply to a dispute you have already told us about. You get a new 30-day window to opt out of the change, counted from the day you accept it.

If part of this section fails. If any other part of this section is found unenforceable, the rest of it stays in force.

Which law applies

Delaware law governs these Terms, without regard to its conflict-of-laws rules. A dispute that does not go to arbitration goes to the state or federal courts in Delaware, except as stated here. You can bring a qualifying claim in your local small-claims court. If the law of your own state requires that a dispute be heard in your state's courts, it goes there instead. Nothing in this section takes away consumer protections you have under the law of the state where you live.

When these Terms change

We update these Terms from time to time.

Price changes follow the notice rules under Price changes. For other material changes to these Terms, we tell you at least 30 days before they take effect. We tell you by email, if we have your email, and in the app. The notice says what changed.

Whenever the words of these Terms change, we ask you to agree again in the app. We ask even when the change is small. You can close the request and keep using Butter, including starting, resuming, or replaying a session. Closing it records no agreement. Your account, history, data choices, cancellation, and account deletion stay available. You can request a refund under Refunds.

Every version stays published at butter.yoga/legal/terms/, one page per version number, so you can read what you agreed to. The version and dates are at the top of this page.

Housekeeping

These Terms, including the list at the top, are the whole agreement between you and us about Butter. The Privacy Policy and the Consumer Health Data Privacy Policy are separate documents. If a court finds any part unenforceable, that part is changed as little as needed or removed, and the rest stays in force. If we do not enforce a term once, we can still enforce it later.

You cannot transfer these Terms to anyone else. We can transfer them as part of a merger, an acquisition, or a sale of assets, and we tell you if we do. We can send you notices in the app or by email.

Some states do not allow some of the limits in these Terms. Where that is true, each limit applies only as far as the law of your state allows.

Contact

A person on our team reads and answers every message in Chat with Concierge. The team is open on weekdays from 9am to 8pm Eastern Time. It is closed on weekends and on team holidays. The app shows when the team is open and when it opens next. While open, we aim to send a first reply within 15 minutes. A message sent while we are closed is answered when we open.
