Butter Consumer Health Data Privacy Policy

This policy explains how Gregarious, Inc. ("Gregarious," "we," "us") collects, uses, and shares consumer health data through Butter, our AI yoga and mobility coach for iOS, and butter.yoga (the "Service").
This is a standalone policy, separate from our Privacy Policy. It applies to consumer health data as defined by the Washington My Health My Data Act, Nevada SB 370, and Connecticut's consumer health data provisions, and it governs that data for all users of the Service.
Butter is a wellness product, not a healthcare provider, and the data below is not medical-record data — but under these laws, information about your body, movement, and physical condition is consumer health data, and we treat it with that level of care.
1. Consumer health data we collect
We collect the following categories of consumer health data:
- Injury and pain notes — anything you tell your coach, by voice or text, about injuries, pain, surgery, or physical limitations. This includes your "Memories" (Life Context) notes and free-form messages to the coach.
- Mobility limitations and body-focus areas — areas of your body you ask the coach to work on, avoid, or go easy on.
- Health details — the name, gender, age, height, and weight you add to your profile.
- Wellness session activity — your movement practice: sessions started and completed, poses held, durations, intensity choices, and streaks.
- Voice-note transcripts — when you speak to your coach, the audio is transcribed on your device and only the text is sent to us. That text is consumer health data when it describes your body or health.
- Inferences — conclusions the coach draws from the above to plan your sessions, such as which areas to load carefully because of an injury you mentioned, or what your practice history suggests about your mobility.
We do not collect precise location, biometric identifiers, or genetic data. We collect coarse location (country, region, city) for app diagnostics as described in the Privacy Policy; we do not use it to infer health status or your presence at any health facility.
2. How we collect and use it
Sources. We collect consumer health data directly from you — what you type, speak, and set in the app — and from your use of the Service (your session activity). Inferences are generated by our systems from those two sources. We do not buy or otherwise obtain consumer health data from third parties.
Purposes. We collect and use consumer health data only to:
- plan and personalize your movement sessions and the coach's guidance;
- speak to you about your practice in the app;
- maintain your practice history and streaks;
- provide customer support when you ask for it;
- keep the Service secure, prevent abuse, and comply with legal obligations.
We use consumer health data only for these purposes and as necessary to provide the Service you request. We do not use it for advertising of any kind.
3. How we share it
We share consumer health data only with service providers that process it on our behalf to provide the Service, under contracts that bind them to protect it and prohibit them from using it for their own purposes:

We do not sell consumer health data. We have not sold consumer health data, and we will not sell it without the separate, valid authorization that the law requires — which we do not seek. We do not share consumer health data with advertisers, data brokers, or analytics vendors, and we do not use it for advertising.
Beyond the service providers above, we disclose consumer health data only if required by law or valid legal process, or to protect the vital interests or safety of you or others. If Gregarious is part of a merger, acquisition, or sale of assets, this policy continues to apply to your consumer health data and we will notify you of any change.
4. Your rights
You have the right to:
- Access — confirm whether we collect, share, or process consumer health data about you, and receive a copy, including a list of the third parties and service providers with whom we have shared it and how to contact them.
- Withdraw consent — withdraw your consent to our collection and processing of consumer health data. Because the coach cannot plan around your body without it, withdrawing consent means some or all of the Service will stop working for you; we will tell you specifically what is affected before you confirm.
- Delete — have your consumer health data deleted, including data we have shared with our service providers. Use the in-app account deletion (Profile → account settings) or email privacy@butter.yoga. Deletion scrubs your health data from our systems, instructs our service providers to delete it, and permanently severs the link between you and any de-identified records that remain, as described in the Privacy Policy.
How to exercise these rights. Email privacy@butter.yoga from the email address associated with your account, or use the in-app controls. We will verify your request using your account and respond within the time required by applicable law (45 days in Washington, extendable once by 45 days where the law allows; we will tell you if we need the extension). Exercising your rights will never cost you anything or change how we treat you.
Appeals. If we deny your request, we will tell you why and how to appeal. To appeal, reply to our denial or email privacy@butter.yoga with "Appeal" in the subject line. A different reviewer will decide your appeal and respond in writing within the time required by law. If your appeal is denied and you are a Washington resident, you may raise a concern with the Washington State Attorney General at www.atg.wa.gov/file-complaint. Residents of Nevada and Connecticut may contact their state Attorney General.
